This agreement between sole proprietor Berbech Olha Anatoliivna (hereinafter referred to as the "Seller") and the user of the website services (hereinafter - the "Customer") is a commission agreement for ordering, purchasing, and delivery of goods and defines the basic terms of ordering, purchasing, and delivery of goods via the website https://indira.ua. By acting with the intention of purchasing goods, the Buyer accepts the terms of this goods sale agreement (hereinafter – the “Agreement”) on the following terms:

1. DEFINITIONS

1.1. A Public Offer (hereinafter – "Offer") is a public proposal by the Seller addressed to an indefinite number of individuals to conclude a remote goods sale agreement (hereinafter - the "Agreement") on the terms specified in this Offer, including all appendices.

1.2. Order – the Customer’s decision to order goods and have them delivered, formalized on the website and/or an instruction to purchase and deliver goods.

2. GENERAL PROVISIONS

2.1. The information below is an official public offer of the online store https://indira.ua to any individual (hereinafter - the Buyer) to conclude a goods sale agreement. This agreement is public, meaning that, in accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers.

2.2. According to Article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of this Offer, which confirms the conclusion of the Agreement, is the fact of placing and confirming an order.

2.3. By placing an order, the Buyer confirms agreement with and unconditional acceptance of the terms of this Offer.

2.4. By entering into the Agreement (i.e., accepting this Offer by placing an order), the Buyer confirms the following: a) The Buyer is fully acquainted with and agrees to the terms of this Offer; b) The Buyer consents to the collection, processing, and transfer of personal data under the conditions set out below in the "Disclaimer on the collection, processing, and transfer of personal data". Consent is valid for the duration of this Agreement and indefinitely after its termination.

Additionally, by entering into this Agreement, the Customer confirms that they are informed (without additional notice) about their rights under the Law of Ukraine "On the Protection of Personal Data", about the purpose of data collection, and that their personal data is transferred to the Seller to fulfill the terms of this Agreement, for settlements, and to receive invoices, acts, and other documents. The Customer also agrees that the Seller may provide access and transfer their personal data to third parties without additional notice, without changing the purpose of processing.

The scope of the Customer's rights as a subject of personal data under the Law of Ukraine "On the Protection of Personal Data" is known and understood.

3. PRICE OF GOODS

3.1. The price for each item is listed on the website.

3.2. The Seller reserves the right to unilaterally change the price of any item.

3.3. If the price of an ordered product changes, the Seller must inform the Buyer.

3.4. The Buyer may confirm or cancel the order if the price changes after ordering.

3.5. The Seller may not change the price of already paid goods.

3.6. Delivery cost is indicated on the website or communicated during the order process.

3.7. The Buyer’s payment obligation is considered fulfilled once the Seller receives the funds.

3.8. Payments are made using the methods listed in the “Delivery and Payment” section of the website.

4. ORDERING GOODS

4.1. Orders can be placed via phone: (066) 410 83 13, (097) 486 15 56, or through the indira.ua website.

4.2. During registration, the Buyer agrees to provide:

  • Full name (or that of the recipient);

  • Delivery address (if applicable);

  • Email address;

  • Contact phone number.

4.3. Product name, quantity, SKU, and price are listed in the shopping cart.

4.4. The Seller may request additional information. If the Buyer fails to provide it, the Seller is not liable for service quality.

4.5. When ordering via phone, the Buyer provides the same data as listed above.

4.6. Acceptance of this Offer is done by entering data into the registration form or by providing it via phone. After ordering, the data is stored in the Seller's database.

4.7. The Buyer is responsible for the accuracy of the provided data.

4.8. The remote purchase contract is deemed concluded at the time of electronic order submission or the issuance of a receipt or document confirming payment.

5. DELIVERY AND TRANSFER OF GOODS

5.1. Delivery methods, procedures, and timelines are listed in the “Delivery and Payment” section of the website and are confirmed with the operator at the time of purchase.

6. RETURNS

6.1. The Customer may refuse non-excise goods at any time before delivery or afterward as per the Law of Ukraine "On Consumer Protection".

6.2. Returns of non-excise goods in proper condition are allowed if appearance, consumer properties, and proof of purchase are retained.

6.3. Goods of proper quality with individually defined properties (e.g., custom sizes) are not subject to return.

6.4. Returns are made to the address listed in the “Contacts” section of the website.

6.5. In case of return, the Seller refunds the cost of the item minus delivery charges.

6.6. Refunds are processed upon return of the goods.

7. LIABILITY

7.1. The Seller is not responsible for damage resulting from misuse of the products.

7.2. The Seller is not liable for failure to fulfill obligations if the Buyer provided false or incorrect information.

7.3. Both parties are liable under Ukrainian law and the terms of this Agreement.

7.4. Neither party is liable for non-performance due to force majeure (e.g., war, natural disasters). Affected parties must immediately notify the other.
